What is Code Compliance?
|
The Code Compliance department is responsible for enforcement of the City's zoning, sign, public nuisance, noise, smoking ordinances and various other City codes. Code Compliance is active in the City's Neighborhood Pride Program and Code Compliance Volunteer Program. Code Compliance is a process that works to ensure that property owners bring their structures and property conditions up to adopted Building, Housing, Nuisance and Zoning Code Standards within the City of San Clemente. We work with other agencies from County, State and City staff to ensure compliance.
Some examples of code violations handled by Code Compliance are: inoperable vehicles stored within public view on private property, trash and debris within public view on private property, dead or overgrown vegetation on private property, etc. The process usually begins with a complaint and a code compliance officer is dispatched to the property in question and performs an investigation. If a violation exists, the owner of the site is given a Correction Notice. If corrective action is not completed in a timely manner, the City may issue an Administrative Citation, abate the nuisance or file a complaint with the City Attorney. The success of the Code Compliance

There are three ways to file a complaint:

Home and Property Maintenance Codes
|
Code Compliance is responsible for maintenance and preservation of homes, buildings and structures as mandated by state and local building and property maintenance codes. Code Compliance inspects all structures suspected of violating code to insure compliance and issues notices of violations to the property owners. Violations can be issued for everything from poor structural integrity to unsafe property site to open storage of junk. If a violation is detected, a letter will be sent to the property owner requesting compliance to avoid fines or further legal actions. Special financing programs may be available to assist owners in the rehabilitation and demolition of structures when they are not financially able to correct cited violations.

Inoperable Vehicles on Private Property
|
It is a violation of San Clemente City Code to store an inoperable or junk vehicle and/or their parts within the public’s view. All inoperable or junk vehicles and their parts stored on private property must be stored within an enclosed garage.

Overgrown Vegetation and Tree Issues
|
Code Compliance occasionally receives complaints and/or concerns regarding trees obstructing views. The City does not have an ordinance protecting private views. The City regulates building heights, but does not regulate tree heights. Another concern regarding trees is when limbs extend from a tree on one property to an adjacent property. This is a civil matter between the affected property owners.
Overgrown vegetation encroaching into the public right-of-way is a code violation and in some cases may cause a vehicle line-of-sight issue which is a safety issue. Code Compliance will contact property owners regarding these types of issues.

Oversized Vehicle Parking on Private Property
|
In January 2000, the “Oversized Vehicle Ordinance” was passed. This ordinance allows for the parking of boats, trailers and oversized vehicles on residentially zoned or developed property. Oversized vehicles are defined as any vehicle which exceeds 20 feet in length, 9 feet in height and/or 7 feet in width. Boats and trailers included in the Oversized Vehicle Ordinance must be parked a minimum of 20 feet from the street curb and not on “required driveways”. Oversized vehicles such as self-powered motor-homes may temporarily (48 hour period to load and unload) be parked on required driveways when maintained in an operable condition. Garage Sale Signs
|
In order to maintain a safe and attractive environment, it was necessary for the City of San Clemente to establish restrictions on the placement, size and number of garage, yard, estate, moving or any other similar sale signs designed to attract and direct potential customers to these events. Currently, the San Clemente Zoning Ordinance, Section 17.84.030 places specific limitations on the placement, size and number of all garage sale signs allowed per location and enforces the current State Board of Equalization’s regulations regarding the number of garage sales allowed per year.
Per the Zoning Ordinance, only one (4 square foot) garage sale sign can be posted at the sale site. No sign(s) may be placed in the public right-of-way (i.e. on telephone poles, stop signs and posts or off the property of where the garage sale is being conducted). When necessary, Code Compliance will contact violating parties and issue Correction Notices to seek compliance, requiring removal of illegal signage. If the signs are not removed, violators could face Administrative Citations of $100 - $500.

Volunteers in Code Compliance Program
|
Since 1994, the City of San Clemente has been proud of the implementation of Volunteers into the Code Compliance Program. These Volunteers are concerned citizens and are the foundation of this program. The objective for the Volunteer is to work together with the City by assisting our code compliance efforts and better address the needs of San Clement residents. Their efforts help preserve and improve residential neighborhoods and help make San Clemente a better place to live, work and play.

Volunteer Program Description
|
Citizen Code Compliance volunteers assume some simple tasks similar to those which are normally performed by Code Compliance personnel. As a volunteer, you will help us protect the value of homes and quality of life in neighborhoods by inspecting different neighborhoods. You will not be asked to inspect your own neighborhood and no interior inspections of structures will be required. You will help us uphold community standards in the following areas:
- Parking of boats, trailers and oversized vehicles that are parked on private property in residential neighborhoods.
- Vehicles parked on lawn/yard areas.
- Excessive accumulations of trash/debris in public view in residential neighborhoods.
- Overgrown weeds/vegetation in residential neighborhoods.
- Trash receptacles in public view.

Volunteer Qualifications & Job Requirements
|
Volunteers are requested to donate a minimum of four hours per week, Monday – Friday and possess a valid California driver’s license.
No specific job experience is required, since you will be trained prior to assuming duties. Generally, you will be assigned field work with a partner.
Applicants will undergo a reference check and screening through the Department of Motor Vehicles.
There is no financial expense on your part. A marked City vehicle and necessary supplies will be provided by the City.

How to Become a Citizen Volunteer
|
- Obtain an application by calling (949) 361-8324.
- Return the completed application and a photocopy of your California Driver’s license to our Human Resources Division at 100 Avenida Presidio, San Clemente, CA 92672.
- All volunteers will be issued a Volunteer City identification card.
- Once your Code Compliance training is completed you will then play an important role in keeping San Clemente beautiful!
